Q. What are the key takeaways of Jammu & Kashmir Reorganizatoon Bill ? In what way does it help in solving the long pending problem?


The Jammu and Kashmir Reorganisation Act, 2019 has created to bifurcate the state into two Union Territories — Ladakh and Jammu-Kashmir.  The Union Territory of J&K will have a legislative assembly, whereas the UT of Ladakh will not have a legislative assembly and will be administered by the Lieutenant Governor alone.
 
Long pending issues of J&K are - insurgency & militancy, separatisit movements,  unemployment, loss of permanent residence by J&K woman when married outsiders, Development of Ladakh, issues of Kashmiri Pandits etc.,


Key takeaways of Jammu & Kashmir


1. Jammu and Kashmir is now UT with Legislative Assembly and tenure is five years unless it’s dissolved earlier by the L-G .  And Law and Order will be under control of the Union Govt like Delhi.  This new set up will help to check on menace of separtisim, provocation against the state etc.


2. Ladhak has become UT -  It has fulfilled long demand of Ladhak people.  By creating as a separate UT it serves two purposes 1) Development 2) Check on China’s interests in the regions.


3. Revocation of Art 370 – Makes implementation of the laws being made for rest of the nation in future and of the past eg RTI Act 2005, IT Act 2000. Also, the principal of one country one constitution come into force.


4.   Revocation of Art 35A -  Now woman of J & K will not lose the property rights when they married outsiders.  Also, outsiders can purchase land for living and investment purpose. It will help to set up new business thereby life of people of the J & K and economy improve.


          With the Jammu and Kashmir Reorganization Act, 2019, the long pending issues of J & K can be addressed but there is need of building faith and belief among civil society including politicians of the state to take forward the provisions of new act effectively.
